Am I Eligible for TN Nonimmigrant Status?

To qualify as a NAFTA professional:

  • You must be a citizen of Canada or Mexico.

  • Your profession must be on NAFTA’s pre-approved list, which is extensive, and includes: scientists, medical professionals, teachers, lawyers, architects, and engineers.

  • A company in the U.S. has pre-arranged a part-time or full-time position for you (self-employment does not qualify).

  • You meet the position’s qualifications, whether related to education level or experience.

An important difference between the requirements for Canadian and Mexican citizens is that Canadian citizens can apply at any point of entry to the U.S. — meaning international airports or land bridges — while Mexican citizens must obtain a TN visa stamp at a U.S. consulate.
